1. About these terms
These terms govern your use of the GetNative app and website (“GetNative”), provided by Utterware (UTTERWARE SRL, CUI 50658798, Trade Register No. J2024028352002, EUID ROONRC.J2024028352002, registered in Bucharest, Romania) (“we”, “us”). By creating an account or using GetNative, you agree to these terms and to our Privacy Policy.
2. Who can use GetNative
You must be at least 13 years old. If you are under the age of digital consent where you live (16 in Romania), you need permission from a parent or guardian, who agrees to these terms on your behalf.
3. Your account
Keep your sign-in details secure; you are responsible for activity under your account. Give accurate information, and tell us at contact@utterware.com if you think someone else has used your account.
4. What GetNative does
GetNative helps you practise English pronunciation and fluency. You record yourself reading or speaking, and AI services score your speech and suggest what to work on.
AI scores and feedback can be wrong, and an accent is never “wrong”. GetNative is a practice tool: it is not an official language test or certification, and its scores should not be used for that purpose.
The reader voices in GetNative are AI-generated voices, not recordings of real people.
5. AI processing
To score your practice, your recordings are sent to Microsoft Azure Speech, and the text of your spoken answers to OpenAI, as described in our Privacy Policy. We only do this after you agree in the app. You can withdraw your agreement in You › Privacy; your practice then can’t be scored until you agree again.
6. GetNative Pro, free trials and payments
- GetNative Pro is an auto-renewing subscription, sold through the App Store or Google Play. The price and billing period are shown before you buy.
- If a free trial is offered, your subscription starts automatically when the trial ends unless you cancel at least 24 hours before it ends. Each account or store account can use a free trial once.
- Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before the period ends. Payment is charged to your App Store or Google Play account.
- You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the app or your GetNative account does not cancel it.
- Refunds are handled by Apple or Google under their policies. Your statutory rights as a consumer are not affected.
- If we change the price, Apple or Google will tell you in advance, and you can cancel before the new price applies.
7. Fair use
To keep GetNative fast and affordable for everyone, we may set a reasonable weekly limit on how much recording time can be scored. If you reach it, scoring resumes at the start of the next week. We may also limit or suspend use that is automated, abusive or harms the service.
8. Your content
Your recordings and answers remain yours. You give us permission to process them only to provide GetNative to you, as described in our Privacy Policy. Recordings are discarded once scored.
9. Acceptable use
Don’t misuse GetNative. In particular, don’t:
- record or upload content that is unlawful, or that you don’t have the right to use, including other people’s voices without their permission;
- try to reverse engineer, copy, overload or interfere with the app or its servers, or get around usage limits;
- use automated means to access GetNative or to collect its content or scores;
- resell GetNative or use it to build a competing service.
10. Our content
GetNative, including its software, design, practice content and generated voices, is owned by us or our licensors. We grant you a personal, non-transferable licence to use the app for your own practice while you follow these terms.
11. Ending your use
You can stop using GetNative and delete your account at any time in the app (You › Delete account). We may suspend or close an account that seriously or repeatedly breaks these terms; where reasonable, we will tell you first. If we close your account without cause, you can contact us about any unused paid period.
12. Availability and changes to GetNative
We work to keep GetNative available and accurate, but we can’t guarantee it will always be uninterrupted or error-free. We may change or improve features over time. If a change significantly reduces what you pay for, we will tell you in advance.
13. Liability
Nothing in these terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, fraud, or your rights as a consumer. Otherwise, we are not liable for indirect or unforeseeable loss, and our total liability to you is limited to the amount you paid for GetNative in the 12 months before the claim.
14. Apple App Store
If you downloaded GetNative from the App Store, these terms are between you and us, not Apple. Apple is not responsible for GetNative or its content, has no obligation to provide support for it, and is not responsible for any claims relating to it. If GetNative fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple’s standard Licensed Application End User License Agreement applies to anything these terms do not cover.
15. Changes to these terms
We may update these terms. We will update the date above and, for significant changes, tell you in the app before they apply. If you don’t agree, you can stop using GetNative and delete your account.
16. Governing law
These terms are governed by the laws of Romania. If you are a consumer in the EU, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
